Dean Kent shares his perspective on patent infringement disputes following a lawsuit filed by the University of South Florida alleging that Stryker Corp infringed on two of its patents. in the Tampa Bay Business Journal.
“Stryker’s response will decide how the proceedings continue and if the two companies can work out an agreement,” said Kent.
After the court appointed a mediator on Sept. 8, Kent suggested that this signified the court is hoping the parties will work it out “before throwing punches.”
Further, the language in the complaint is professional, direct, and concise, which Kent said is a clear signal USF isn’t looking for extensive or aggressive litigation. “Because USF doesn’t have a competing product, the lawsuit should get the parties to sit down and discuss a future royalty-based resolution instead of litigation,” Kent said, referring to the proceedings.
